Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Devise Learning (the “Service”). By accessing or using the Service, you agree to these Terms.
1) Who we are
Devise Learning provides language-learning tools including graded reading content, AI chat assistance, and journaling feedback. If you have questions about these Terms, contact us at [email protected].
2) Eligibility and accounts
You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.
3) Subscriptions, billing, and payments
Paid plans are offered as subscriptions. Payments for subscriptions are processed by Lemon Squeezy. By purchasing a subscription, you agree to Lemon Squeezy’s applicable terms and policies (including their Terms of Service) in addition to these Terms.
When you start a subscription, you authorize us (through Lemon Squeezy) to charge your selected payment method on a recurring basis at the cadence shown at checkout (for example, monthly or yearly) until you cancel. Unless otherwise stated, subscriptions renew automatically at the end of each billing period.
You can manage your subscription (including cancellation, payment method updates, and invoices) through the billing/portal experience provided via Lemon Squeezy. Changes such as cancellation typically take effect at the end of the current paid billing period unless otherwise stated at the time of change.
4) Refund policy
We want you to be happy with the Service. If you believe you were charged in error or the Service is not working as expected, email us at [email protected].
Refunds, if approved, are processed through Lemon Squeezy to the original payment method. Unless required by law, fees paid for subscriptions are non-refundable, and we do not provide prorated refunds for partially used billing periods. We may consider exceptions on a case-by-case basis.
5) End-user rights (license to use the Service)
Subject to these Terms and your payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. You may not resell, sublicense, or make the Service available to others as a hosted service.
6) Fair use and limits
The Service may include usage limits (for example, message or feedback limits on AI features) and other restrictions depending on your plan. We may enforce limits to protect the Service, prevent abuse, and manage costs.
7) AI features disclaimer
The Service may provide AI-generated responses, summaries, translations, or feedback. AI output can be inaccurate or incomplete and is provided for informational and educational purposes only. You are responsible for how you use AI output, and you should verify important information.
8) Acceptable use
You agree not to misuse the Service. This includes (but is not limited to) attempting to disrupt the Service, probing or scanning for vulnerabilities, reverse engineering, scraping in a way that harms performance, or using the Service to generate unlawful or harmful content.
9) Your content
You may provide content to the Service (for example, journal entries and chat messages). You retain ownership of your content. You grant Devise Learning a limited license to host, process, transmit, and display your content only as necessary to operate, maintain, and improve the Service.
10) Content and intellectual property
The Service and its software, design, and branding are owned by Devise Learning and are protected by applicable laws. Third-party content (such as source articles) may be subject to third-party licenses and attribution requirements.
11) Termination
We may suspend or terminate access to the Service if we believe you have violated these Terms or if it is necessary to protect the Service, our users, or third parties. You may stop using the Service at any time.
12) Disclaimers and limitation of liability
The Service is provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, Devise Learning will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.
13) Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to provide notice. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
